•  PEDESTRIAN RECEIVES JUDGMENT IN THE AMOUNT OF $515,763.20 AFTER BEING HIT BY MOTOR VEHICLE.

On December 24, 1994 a gentleman was walking across the street when the driver of a 1988 Pontiac, who had alcohol on her breath, hit the pedestrian, causing serious injuries. Plaintiff's counsel, Kenneth G. Egan, represented the Plaintiff against the Defendant for her negligent driving. The Defendant was cited for careless driving, and driving on a suspended license. The actual collision took place off the roadway where the driver had lost control of her vehicle. The impact was so severe the seat in the motor vehicle of the driver actually broke upon impact with the Plaintiff pedestrian.

 

•  MAN RECEIVES JUDGMENT IN THE AMOUNT OF $16,000.00 IN COMPENSATORY DAMAGES AS WELL AS AN AWARD OF $32,466.75 IN ATTORNEY FEES AS A RESULT OF BEING INCARCERATED BEYOND HIS ORIGINAL RELEASE DATE.

A man who had been arrested for burglary of a residence resulted in a prison sentence. The prison made a mistake in their records and kept the Plaintiff incarcerated for his offense beyond the date he should have been released.

Even an individual incarcerated, who has had numerous problems in his past, has an equal right to civil rights and liberty as guaranteed by the United States Constitution and the jury agreed.

 

•  PLAINTIFF RECEIVES JUDGMENT IN THE AMOUNT OF $143,701.43 AFTER A 12 PERSON JURY TRIAL.

  The Plaintiff while traveling on State Road 273 in Sunland Park, New Mexico was stopped to make a left turn. The Defendant was traveling behind the Plaintiff in the same direction. The Defendant rear ended the Plaintiff. Immediately after the accident the Defendant approached the Plaintiff and offered her money if she would not report the collision to the police department. Plaintiff declined to do so. The police where immediately called. The Defendant then attempted to flee the scene, however his vehicle would not move because his bumper was stuck in his tire. His vehicle later had to be towed from the scene. When the police arrived at the scene they noticed that the Defendant had blood shot watery eyes, slurred speech, and smelled of alcohol. The Defendant failed the IR5000 breathalyzer test and had a breath score of .16. This is twice the legal limit in New Mexico.

As a result of the collision the Plaintiff was injured. Her total medical expenses were $7,011.28. Kenneth G. Egan argued to the jury that it needed to set an example against the Defendant for his irresponsible and wreckless conduct. They agreed and did so.

Prior to trial Defendant had offered to settle the case for $14,000.00. That offer was rejected by the Plaintiff. The jury ultimately awarded Plaintiff her damages and she received a check in the amount of $143,701.43.

 

•  PLAINTIFF RECEIVES AN AWARD AGAINST THE DEFENDANT IN THE AMOUNT OF $250,000.00 AS A RESUTL OF DAMAGES FROM A CAR ACCIDENT.

The Plaintiff was driving in Deming, New Mexico on State Road 11 when the Defendant made an improper turn and hit the Plaintiff's vehicle. This resulted in serious personal injuries to Plaintiff. After mediation being held at the Third Judicial District Court, County of Dona Ana, State of New Mexico, an agreement was made that the Plaintiff was entitled to $250,000.00 to properly compensate her for the injuries she sustained.

 

•  PLAINTIFF RECEIVES AN AWARD AGAINST THE NEW MEXICO LOTTERY AUTHORITY IN THE AMOUNT OF $175,000.00.

The Plaintiff while driving a motor vehicle on February 4, 1998 was hit by another motor vehicle owned by The New Mexico Lottery Authority. As a result the Plaintiff sustained serious personal injuries. After presentation of Plaintiff's injuries to the Defendant an agreement was made that Defendant would pay Plaintiff the amount of $175,000.00.

 

•  PLAINTIFF RECEIVES JUDGMENT IN THE AMOUNT OF $125,000.00 AGAINST GOLDEN CORRAL RESTAURANT IN LAS CRUCES, NEW MEXICO.

 

Plaintiff while walking through the Golden Corral restaurant in Las Cruces, New Mexico slipped on a letter which had fallen from the restaurants marquee sign to the parking lot. Plaintiff landed on her knee and shattered her patella.

This case was decided by a 12 person jury trial. Prior to jury verdict the defense had offered to settle the case for $35,000.00 which was rejected by Plaintiff. Plaintiff chose to proceed through completion of jury trial where the jury awarded $125,000.00 to compensate Plaintiff for her injuries.
